Rumors say, yes. ?He's a great actor, he's been in every kind of movie (Syriana, Basquiat, Angels in America, Shaft remake), he's even been the bad guy before (Shaft). Maybe the "Live Free or Die Hard" script is good-ish (doubtful), maybe he's in need of a man-sized paycheck, either way, he makes us wanna see this. A little.
