Criminal justice sentencing and types of criminal sentences.A criminal sentence is the final decision of the judge in a trial. Criminal sentencing is considered to be the outcome of the trial as it states if the defendant was found guilty and what will be their punishment. Criminal justice sentencing originated in the ancient Roman law system and is still in use today. There are different types of criminal sentencing. Criminal sentencing may be labeled according to the degree of jurisdiction of the institution that will process the trial (tribunal, appeal, Supreme Court, Constitutional court, etc). Criminal sentencing guidelines emphasize on two main factors that must be taken into account. One of those factors is the criminal history of the defendant. The other is the level of the crime. Further, criminal sentencing guidelines explain how the level of the crime must be determined (there are four zones and 43 levels of crime classification) and how these two factors interact to form the final criminal law sentencing. |
